Paraiso Miami Swim Week secures 'victory' in trademark dispute over event name

Paraiso Miami Swim Week, the leading organiser behind global swimwear show Miami Swim Week, has said that it has secured a “major legal victory” in an ongoing legal dispute over the trademark rights of the ‘Miami Swim Week’ name against another event producer from out of state.
According to the event’s parent company, Funkshion Productions, the ruling will cancel a trademark registration from the Miami Swim Week The Shows, a DC Swim Week Group-owned (DCSW) event, which reportedly was “causing confusion among the industry and its consumers.”
It must be noted that no final ruling has been made against DCSW’s ownership of the ‘Miami Swim Week’ trademark, which is still currently registered with the US Patent and Trademark Office (USPTO) and remains under the ownership of the DCSW Group.
Funkshion’s trademark application for ‘Miami Swim Week’ is still pending with the USPTO and legal proceedings in regards to the dispute between the two organisers remains ongoing.
Trademark Trial and Appeal Board rules 'Miami Swim Week' trademark 'improperly registered'
The two event organisers have been embroiled in a legal dispute since 2022, with both hosting independent schedules during the period with a varying line up of presenting brands, designers and participants.
In a press release, however, Funkshion said that the Trademark Trial and Appeal Board determined that DCSW’s Miami Swim Week The Shows had “improperly registered” the ‘Miami Swim Week’ trademark. More so, the event producer’s ongoing use of the phrase was leading to a misunderstanding among consumers of the differences in events, the organiser stated.
In addition, the ruling alleged there was evidence that the out-of-state event had used images from Paraiso Miami Swim Week’s fashion shows without permission, reinforcing its perceived intent to leverage and capitalise on the event’s leading reputation.
DCSW has since filed a federal lawsuit in the Southern District of Florida against Funkshion for trademark infringement, false representation, and fraudulent claims of prior use, the organiser told FashionUnited. The filing challenges Paraiso’s trademark application, which DCSW has alleged is “based on false specimens of use and declarations”.
As such, DCSW is calling on the court to “review and vacate a recent decision” made by the Trademark and Appeal Board, underlining the company’s intent to “stop Paraiso and Funkshion from wrongfully asserting ownership of its registered trademark”.
